In compliance with consumer protection and defense legislation, Aero Arte® provides options for exchanging or returning products: due to product defect.

Return or Exchange for Defective Product

If the product is defective, the Consumer may request the return or exchange of the defective product within 30 (thirty) days after receiving the order. If the deadline ends on a Saturday, Sunday or holiday, the Customer may communicate the repentance until the first subsequent business day. To open an exchange or return request, the customer must send an email to contato@aeroarte.art.br.

Shipping Policy

 

1. Production time

Aero Arte® makes available in its virtual store some products that are made after the purchase order, therefore, the postage is carried out within 5 (five) business days after confirmation of payment.

2. Delivery deadlines
During the purchase process, Aero Arte® will inform the Customer of an estimated time for delivery of the Products. This estimate takes into account the products purchased, their quantities, the available stock and the distance between our distribution center and the delivery address informed by the Customer. The delivery period will be counted from the date of approval of the order, which can take up to 3 (three) business days.

3. Shipping costs

The shipping costs for the delivery of the products is automatically calculated by the website at the time of purchase, based on the weight, volume and quantity of the products purchased, as well as the distance between our distribution center and the delivery location informed by the Customer. At its sole discretion, Aero Arte® may make available on its website special shipping categories, specific to some products and to some locations, permanently or temporarily. In this case, it is possible that each category offers different prices and delivery times, and it is up to the Customer to choose the category that meets their expectations.

4. Free shipping

Eventually, Aeroarte will be able to carry out campaigns with the shipping paid by the company, without any  cost for the customer. In this condition, the shipping method will be exclusively at Aeroarte's discretion, and may be via regular Post Office or partner carrier, and the customer is not responsible for choosing the shipping method. Delivery times remain unchanged.

This site is owned, maintained, and operated by Aero Arte®, registered as "Eduardo Harasem Ulyssea 03274096903", Tax. no. 19.598.326/0001-90.

If the User needs any information, clarification or assistance in relation to this Privacy and Security Policy, Aero Arte® provides the communication channels listed below: a) By e-mail contato@aeroarte.art.br, and b) By telephone +55-41-99711-9491, from Monday to Friday, from 8:00 am to 6:00 pm, always accompanied by the Consumer's contact information, so that we can finalize the service. In all cases, the User will receive, through the same communication channel, an immediate confirmation of the receipt of his demand, which will be dealt with and answered within a maximum period of 5 (five) days. In addition, Aero Arte® makes available on this site a FAQ (Frequently Asked Questions) section, as well as its other policies: Exchanges and Returns Policy, Product Delivery Policy, and, finally, the Terms and Conditions of Use of this Site. All these documents can be consulted online or downloaded by users in PDF format for offline consultation and archiving.

 

3. General information

Aero Arte® takes all necessary measures to protect the User's privacy, in compliance with current legislation. This document details the ways of collecting, storing, using, sharing and disclosing your personal data, as well as clearly pointing out the measures taken to ensure the protection of the data collected.

 

4. Collection, use and storage of data

Data collection: Access Account. To create an Access Account on the Site, the User must complete a registration, which may vary in complexity according to the operations he intends to perform. Thus, a simple registration consisting of an e-mail address and zip code will be required to send advertising and promotional messages to the User about products, services, promotions and/or news from Aero Arte®. To make Purchases, the User must create a complete Access Account, providing full name, email address, telephone number, CPF, full address (state, city, neighborhood, street, number, complement, extra information) . The data provided by the Users will be stored and used by Aero Arte®, by itself or by third parties contracted by it, to provide the products of the Site, carry out commercial transactions, process payments related to them, share data, send emails of offers , products, services and marketing campaigns, store the history of viewed products, promote retargeting campaigns, customize pages on the Site, verify bank details to prevent fraud (data will not be stored) and carry out deliveries and returns. The data may be shared with third parties hired by Aero Arte® under the terms of this Policy, emphasizing that the creation of each Access Account or any registration on the Site, for which it is necessary to send any personal data of the User, presupposes the express consent to the collection, use, storage and processing of personal data. The User is responsible, in the civil and criminal spheres, for the veracity and updating of the data provided (including personal data) and Aero Arte® disclaims any liability for damages resulting from incomplete, inaccurate or inaccurate refilling of the registration by the User, under any means or form, or even by the improper use of this registration by any third party not authorized to use such data, or even by third parties that have, duly or improperly, obtained the User's data to access the Site, acting as if he was.

Data collection: Cookies. The User may and may, at any time, if he disagrees with the above cookie policy, use the tools of his browser that prevent the installation of cookies and also delete any existing cookies on his internet connection device. In this case, some features of the Site may show errors. Aero Arte® may also use other technologies to collect browsing data from Users, committing to save, process and use them in accordance with this Policy.

Data collection: Access logs. Aero Arte® will keep in its database all the information related to the User's access to the Site, including, but not limited to, the IP address, the pages accessed, the times and dates of access, and the access device used, in terms of current legislation. Such records may be used in internal or public investigations to investigate practices that may cause any damage to Aero Arte®, including the practice of crimes in virtual environments. Data collection: Other ways. Aero Arte® may collect personal data from the User, other than those identified here, that are entered by the User and about the User voluntarily in the process of browsing the Site or when contacting our Customer Service. Finally, Aero Arte® may access public or private databases to confirm the veracity of the personal data provided by the User, including data related to the payment of the Purchase.

Use of data: E-mail. Aero Arte® will use the User's email primarily to send information about their Purchases (Purchase confirmation and status updates). The registered e-mail will also be used to recover the Client's access password, in case the password is lost or forgotten.

Data usage: Advertising via direct mail, email, MMS or SMS. When registering their contact details, the User will have the option to accept or prohibit the sending of advertising messages. Furthermore, at any time, the User may change his decision, by accessing his Account on the Site or by contacting our Customer Service or, even, in the unsubscribe field in the newsletters sent by Aero Arte®, in which case in case the deregistration from the database may take up to 5 (five) days to be effective.

Use of data: Other ways. In addition to the ways set out above, Aero Arte® may, at its sole discretion, use the User's personal data in the following ways: (i) updating the registration; (ii) guarantee of the User's safety; (iii) response to the User's own requests; (iv) information about changes to the Terms and Conditions of Use or the Policies; (v) preparation of statistics regarding the use of the Site, guaranteeing the anonymity of the User, including for the purpose of improving and understanding the User's profile for the improvement of the Site; (vi) improvement of interactivity tools between the Site and the User, guaranteeing their anonymity; (vii) compliance with court orders; and (viii) defense of Aero Arte®'s rights against the User in judicial or administrative proceedings.

Data guard. Aero Arte® will keep all data collected in its secure and secure databases. Such data will only be accessed by automated computer processes, authorized professionals and in the cases listed in this Policy. If the User requests the deletion of their data from the database, Aero Arte® reserves its right to keep the data in question in backup copies for up to 6 (six) months, in order to comply with legal obligations of mandatory storage.

 

5. Data sharing and dissemination

Aero Arte® has the confidentiality of the User's personal data as a priority in its business. Thus, it undertakes not to disclose, share, give access to, facilitate access to, rent, sell, exchange or in any other way make such information available to third parties, under any pretext, except in cases expressly authorized by the User, including in cases indicated below. For the sole purpose of allowing the completion of Purchases on the Site, Aero Arte® may share Users' personal data with its business partners, such as payment processing companies, credit card administrators and carriers. In this case, only the personal data essential for the commercial partner of Aero Arte® to carry out its activity (collection, delivery, etc.) will be shared. Furthermore, such business partners will be obliged, by means of confidentiality agreements, not to file, keep on file, compile, copy, reproduce or share such data with anyone. The other possibility of disclosing personal data is through a court order. Also in this case, disclosure will occur only to the extent necessary to comply with the court order, with data not required by the authority in question remaining confidential.  

 

6. Data transmitted without request from Aero Arte®

Aero Arte® requests the User not to send Aero Arte® any commercial information, personal creations, ideas, photographs, projects, concepts, etc (Unsolicited Content). Such Unsolicited Content will be summarily discarded, without any reading or incorporation into Aero Arte® databases. Under the terms of the Copyright Law, ideas, abstract conceptions, projects, plans and schemes are not susceptible to protection in Brazil. In this way, the eventual use by Aero Arte® of any Unsolicited Content will be the result of internal and independent development and may occur freely, with no authorization or compensation being due or required to the user or consumer. Aero Arte® independently develops all its policies and activities, rejecting any accusation or allegation of use of Unsolicited Content.

 

7. Security measures 

Technological resources. Aero Arte® adopts advanced technological resources to ensure the security of all personal data collected and stored. Not even Aero Arte® employees have free access to the Users' database, which is limited only to those people whose functions require contact with personal data. Among the security measures implemented are the use of modern forms of encryption and the installation of barriers against undue access to the database (firewalls). Such measures can be verified by the User accessing the Site by viewing the “security lock” on his internet browser.

Password secrecy. Aero Arte® recommends that the User keep his password under complete secrecy, avoiding its disclosure to third parties. Aero Arte® will never ask the User to inform his password outside the Site, by telephone, email or by any other means of communication. The User's password must be used exclusively when accessing the User's Account on the Site. If the User suspects that his password has been exposed to third parties, Aero Arte® recommends the immediate replacement of the password.

Suspicious emails. Aero Arte® sends the User only e-mails with advertising messages, advertising products and services or updating information. Aero Arte® does not send messages (i) requesting personal data from the User; (ii) requesting the User's password or financial data; (iii) with attached files except PDF documents; or (iv) with file download links. If you receive an email with such characteristics, please disregard it and contact our Customer Service.

Credit cards. Aero Arte® does not store the User's financial information, such as credit card information, in its database. The payment approval procedure takes place between the User, the banks and the card administrators, without the intervention of Aero Arte®.

Impossibility of accountability. Despite Aero Arte®'s best efforts, the current state of technology does not allow the creation of an absolutely secure database against attacks. In this way, Aero Arte® disclaims any liability for damages that may be caused by third parties, including invasions of the Site or the database, viruses or leakage of information, unless Aero Arte® is solely at fault.

 

8. People's rights over the data collected

Aero Arte® allows the User to make different types of registration, containing more or less information according to their own purpose on the Site. Thus, the User has the possibility to choose the form of registration, and must fill it with true and updated information. The User declares that he/she is the legitimate holder of his/her personal data and may, at any time, use the Site's tools to edit, update or preventively remove them from our database. Aero Arte® will keep the preventively removed data confidential for a period of six months, to meet legal obligations of mandatory custody, definitively discarding them after such period. Aero Arte® also provides tools for the User to determine some uses of their personal data, such as authorization to send advertising pieces.  

 

9. Use of data in case of change of control of Aero Arte®

The data collected may eventually be transferred to a third party in the event of a change in control, an acquisition, a merger, a merger or a sale of Aero Arte® assets in any way or form.
